1. Overview and Agreement to Terms

This website is operated by FX Video Game Exchange LLC. Throughout the site, the terms "we", "us", and "our" refer to FX Video Game Exchange LLC. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").

These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Please read these Terms of Service carefully before accessing or using our website.

2. Products and Sales Policies

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

A. Pre-Owned Consoles & Video Games

• Quality Assurance: We are committed to quality. Every pre-owned, refurbished, and remanufactured console sold by FX Video Game Exchange is thoroughly inspected, repaired, and tested by our expert technicians before it is listed for sale and shipped.

• Hardware Warranty: We stand by our work. All pre-owned hardware (consoles) comes with a parts and labor warranty, covering defects in workmanship and materials.

  • The specific warranty period is 90 days to 120 days, depending on the item's classification (e.g., "Refurbished" vs. "Remanufactured").

  • The exact warranty period for your specific item will be clearly stated on the product's online description page and/or your final receipt.

• Warranty Exclusions: This warranty is voided by and does not cover accidental damage (such as drops or spills), misuse, insect infestation, unauthorized "modding" or repairs, or any issues caused by user-installed software or hardware.

B. Apparel, Clothing & Accessories

• Third-Party Fulfillment: Our apparel, clothing, and accessory items (such as t-shirts, hats, etc.) are produced and fulfilled by a third-party print-on-demand distributor. These items are made to order and shipped directly from their facility.

• RETURNS & EXCHANGES (APPAREL): ALL SALES ARE FINAL.

  • Due to the custom, on-demand nature of these products, we DO NOT accept returns or exchanges for clothing or accessory items. This includes, but is not limited to, returns for incorrect sizing, "buyer's remorse," or color preferences. Please consult the sizing chart on the product page before placing your order.

• Damaged or Incorrect Items: In the rare event that your clothing or accessory item arrives with a manufacturing defect (e.g., a print error, defective material) or is not the item you ordered, please contact us immediately. You must email Bruce@FXVideoGameExchange.com within 7 days of delivery.

  • Please include your order number, a description of the issue, and clear photographs of the defect. We will work with our distributor to find a resolution.

3. Intellectual Property Rights

• Our Trademarks: The names "FX" and "FX Video Game Exchange" are registered trademarks of FX Video Game Exchange LLC. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FX Video Game Exchange LLC.

• Third-Party Trademarks: All other trademarks, service marks, graphics, and logos (such as console brands, game titles, publisher names, and character images) used in connection with the website are the trademarks of their respective owners. Their use on this site is for identification purposes only and does not imply any affiliation with or endorsement by their respective owners.
